🇺🇸 German Pension Refund for U.S. Citizens

You worked in Germany, paid into its pension system with every paycheck — and then moved home and mostly forgot about it. Germany didn't. As a US citizen, you can claim a German pension refund if you have fewer than 60 German contribution months, at least 24 months have passed since your last mandatory pension contribution in Germany, the EU, the UK, Türkiye, Bosnia and Herzegovina, Kosovo, Montenegro, North Macedonia or Serbia, and you live outside the EU, the UK and India. Living in the USA never blocks your claim, and neither do your Social Security contributions.

Do I qualify for a German Pension Refund as a US Citizen?

Short answer: if your German contributions stayed under 5 years and the last one is more than two years behind you, very likely yes.

The longer answer comes from the Social Security Agreement between Germany and the United States, which sets three conditions. First, fewer than 60 German contribution months — less than 5 years, including any months credited for unemployment benefits or child-raising periods. Second, at least 24 months since your last mandatory pension contribution in Germany, the EU, the UK, Türkiye or an ex-Yugoslav country. Third, you live outside the EU, the UK and India — Wyoming, Brooklyn and Honolulu all qualify equally.

Tick all three boxes, and the German pension office (Deutsche Rentenversicherung) owes you money.

The 60-month rule for US citizens

The counting is very German in its precision: one insured day in a calendar month, and the whole month goes on your record. Employment, months on unemployment benefits and parental leave all count toward the 60. Stay under 60 months and the refund route is open. Reach 60, and you've instead earned a German old-age pension at retirement age — payable worldwide, including in the USA. Either way it comes back to you: as a lump-sum refund now, or as a monthly pension later.

Living in the USA — no residence rule

Some agreement countries come with residence small print. The USA doesn't: living in the United States never blocks your German refund. Your American Social Security doesn't get in the way either — paying into the SSA has no effect on your eligibility and doesn't restart the waiting period. The two systems simply don't argue with each other. What decides your claim is your citizenship and the three conditions above — not your ZIP code. (One exception on the residence side worldwide: living in India blocks a refund for anyone without Indian citizenship — relevant only if you move there.)

When can you apply?

24 full calendar months after your last mandatory pension contribution in Germany, the EU, the UK, Türkiye, Bosnia and Herzegovina, Kosovo, Montenegro, North Macedonia or Serbia. The clock starts with your last month of employment or credited benefits — not your deregistration date — and your application is judged on the day it's filed. Once validly submitted, it stays valid: you could take a job in Berlin the day after and your claim wouldn't flinch.

One honest note: the pension office can verify EU and UK insurance periods. A refund obtained while actually living or insured in the EU or UK can be withdrawn retrospectively, reclaimed and enforced. If your situation is unclear, ask us first — asking costs nothing.

How much can you get back?

Among our retained completed paid cases for US citizens, the average refund was €13,407 and the median €12,698 (2026 Q3 calculation) — with overall results across all nationalities ranging from under €200 to over €53,000. The exact amount depends on what you paid in. Refundable contributions include:

  • 100% of the pension contributions withheld from your salary during employment in Germany.
  • 50% of voluntary contributions made, such as those from freelance work.
  • Adjustments for contributions added or deducted through pension equalization after a divorce before a German court.

Since 2018, the employee share has been 9.3% of your gross earnings, up to a monthly income ceiling the Germans call the Beitragsbemessungsgrenze — a word you will never need to pronounce, set at €8,450 per month in 2026 (2025: €8,050). Earnings above that line were never charged, so there's nothing to refund on them.

How much does it cost to claim my refund?

Our fee is 9.75% of the refunded amount, capped at €2,500 even for the largest refunds — including VAT and our partner law firm's support within the agreed administrative scope. Separate representation in an objection, appeal or court proceeding is not included automatically. No hidden charges, no hourly surprises. And because we only get paid after your refund lands, the worst-case math is quick: no refund, no fee, no invoice.

What you need to apply

Less than you'd fear: your valid passport, your German pension number (Versicherungsnummer) — our German social security number guide shows where to find it — your approximate employment dates and employers, your current address and bank details, plus your deregistration certificate (Abmeldung), if you have one. Missing something? That's normal after a transatlantic move — we can help recover your pension number, and German deregistration is available as an optional €50 add-on (including VAT). You don't need to obtain your insurance record yourself first: we obtain and review the relevant account information during the managed process where required.

Is the process digital?

For most clients, yes — you submit your details and sign everything online, and we handle the communication with the pension office. One document needs an analog moment: a short Certificate of Life and Nationality we prepare for you, which must be confirmed by a notary or another authority accepted by the responsible pension office. Online notarization is often accepted, and a local notary works too — many clients send us the scan the same day (any local notary or certification cost is borne by the client). And when DRV Oldenburg-Bremen is the office responsible for your refund, we prepare the power of attorney and payment declaration and ask you to send us the signed originals — a limited exception rather than the rule.

Do I need a German bank account?

No. For security, your refund travels through an escrow account managed by our German partner law firm, and the remaining balance is then transferred to the bank account you nominate — US accounts included. A third-party account can be used where the required account-holder declaration and compliance checks are satisfied. Account-holder checks, international sanctions and banking restrictions can limit where — and in which currency — the money can be sent.

How long does it take?

More than three quarters of our 300 most recent completed refunds reached the client escrow account within three months — 229 of 300 (76.3%) within 90 days of complete submission, with a median of 40.5 days — see the full data and methodology. Individual processing times vary. We prepare every claim so the pension office can process it without avoidable follow-up questions — the process is designed to avoid preventable delays.

The final tempo is set by the responsible pension office, though. Some claims sit longer because of departmental workloads or internal checks; in our latest 300 completed refunds, 93.3% reached escrow within six months, and the remaining cases took longer. Annoying, but never dangerous: your entitlement doesn't shrink while you wait — and German law can provide 4% annual interest from the seventh calendar month after your complete application reached the pension carrier. Germany may be the only place where slow paperwork can pay you.

You're never waiting alone, either. We monitor known response deadlines, follow up with the pension office within the managed scope, and send you a status update at least every four weeks during an active claim — even when the update is simply "still their turn." And six months without a decision has a legal meaning in your favor: an inactivity action (Untätigkeitsklage) can become available as a case-dependent last resort — in our operating history, none has yet been required.

Did your spouse or parent work in Germany?

If a family member died with German pension contributions on record, those contributions may be claimable by you. If their German record stayed under the five-year qualifying period, the closest family — spouse or registered partner first, then children — can claim a refund of the contributions. There is no waiting period, but this claim expires four years after the end of the year of death, so it's worth acting early. If the record reached five years or more, a refund is not possible — but a German widow's or widower's pension may be payable instead, anywhere in the world, including the USA.
